BECOMING A 457 VISA SPONSOR
There are two ways to become an approved sponsor.
- Apply to be a standard business sponsor; or
- Negotiate a labour agreement.
We’ll focus here on the process of becoming a standard business sponsor, since it’s the most common way to sponsor a 457 visa holder.
WHAT DO YOU HAVE TO SHOW?
To become a sponsor, you must declare that your business is lawfully operating and has not relevant adverse information against it. You must also attest in writing that you are committed to employing local labour and do not discriminate in your recruitment practices.
THE PROCESS OF BECOMING A STANDARD BUSINESS SPONSOR
You may only have on standard business sponsorship approved at a time. The sponsorship is usually valid for five years. You are able to extend this by lodging a variation application at any time.
For a business in Australia to become a standard business sponsor, you must make the attestation and declaration (as referred to above) in your sponsorship application form.
You must also meet certain training requirements, requiring you to either:
- Meet the training benchmarks if you have traded in Australia for 12 months or more; or
- Have an auditable plan to meet the training benchmarks if you have been trading in Australia for less than 12 months
